A judge cleared Universal and Sony to accuse Suno of pirating YouTube. What changes for appeals this week.
On August 18, Judge F. Dennis Saylor formally cleared Universal Music and Sony Music to accuse Suno of pirating YouTube to train its model. On August 25 they filed the amended complaint. It's the first time a US court allows a generative AI company to be charged under DMCA section 1201(a) — the same legal mechanism used against YouTube stream-rippers.

Why this lawsuit is different from earlier ones
The original suit against Suno rests on "fair use" — a legal argument that can take years to resolve. Section 1201(a) is cleaner: it bans decrypting copyright protection mechanisms. YouTube uses a "rolling cipher" to protect its videos, and Suno decrypted it using tools like YT-DLP. That's not interpretable: they either did it or they didn't. And the Suno source code leaked in July already confirms it.

If you're fighting an appeal because a distributor rejected your song for "suspected AI", this gives you new leverage. The model that likely generated the tracks you're competing against isn't just "controversial" anymore — it's formally accused of pirating its training data.

The picture that's forming
Warner already settled with Suno back in November 2025 — took a license and stepped out. Universal and Sony are pushing forward and now have fresh ammunition. In Germany, GEMA won its case against Suno on July 31. Round Hill Music joined the wave of lawsuits on August 26. The list of courts and plaintiffs against Suno grows every month, not shrinks.
